The Tolkien Society is a charity registered in England and Wales (no. 273809). Its registered address is 3 Tithe Barn, Merton, Bicester, OX25 2NF, United Kingdom.
Upon joining the Tolkien Society, you agree with the following terms and conditions:
- The Tolkien Society is a registered as a Charity (number 273809) with the Charity Commission for England and Wales. As such its operation is subject to the laws governing the operation of charities in England and Wales. Information about charity law in England and Wales can be found on the Charity Commission’s web site.
- The governing document of the Society is its Constitution, as amended from time to time by General Meetings of the Society. If there is a conflict between this document and the Constitution then the Constitution takes precedence.
- Membership of the Society is subject to receipt by the Society of the correct membership fee. Membership may be paid for in units of 12, 24, 36 or 48 months. The first 12 months membership will run from the date of receipt of payment until the end of that month in the following year (for example if payment is received on 12 March 2003 then the first years membership will run from 12 March 2003 until 31 March 2004). At the Membership Secretary’s absolute discretion he/she may continue the first membership period to the last day of the next month if payment is received in the last few days of a month. Each subsequent 12 months of membership will run from the date following the last day of membership for a period of 12 months (for example if the first 12 months of membership ends on 31 March 2004 then the second 12 months will start on 1 April 2004 and will end on 31 March 2005).
- If membership is renewed within 6 months from the last day of membership then it will be back dated to the day following the last day of membership unless the person concerned explicitly requests that membership be restarted from the date payment is received. (for example if the last day of membership was 31 March 2003 and payment for 12 months membership is received on 8 September 2003 then the payment will be treated as payment for the period 1 April 2003 to 31 March 2004.
- If membership is renewed more than 6 months from the last day of membership a new period of membership will be restarted based on the date of receipt of the payment unless the person concerned explicitly requests that their membership be back dated.
- If a payment is received which is less or more than that due for 12, 24, 36 or 48 months then the Membership Secretary may, at their absolute discretion, adjust the period of membership to reflect the amount paid. However all memberships will end on the last day of the month in which renewal is due.
- Where payment is made by transfer direct to the Society’s bank account the amount received by the Society for purposes of these terms and conditions is the amount after the deduction of any charges made by the Society’s bank or any other bank.
- Where payment is made by a cheque or other instrument in any currency other than British pounds or which is drawn on a bank which is not a member of the United Kingdom’s clearing system, then the amount received by the Society for purposes of these terms and conditions is the amount after conversion to British Pounds and the deduction of any charges made by the Society’s bank or any other bank.
- In the event that a payment is rejected by any bank or credit card company then the membership will be suspended until valid payment of the membership fee (and at the Society’s discretion, payment of any additional costs incurred by the Society because of the rejection of the payment) is received by the Society. If valid payment is not received then membership will be terminated. Any such termination may be back dated to the date when the rejected payment fell due.
- Any contractual relationship created between the Society and any member is made under the Laws of England and Wales. Any dispute between the Society and any member will be governed by the Laws of England and Wales. Any legal action arising from the relationship between the Society and any member will be pursued in the English Courts unless both the member concerned and the Trustees of the Society agree otherwise.
- Note that for the purposes of the Consumer Protection (Distance Selling) Regulations 2000 membership is a service including the supply of periodicals and may not be cancelled after the service has commenced. The service commences at the point when the first magazine has been consigned to a provider of a Universal Postal Service or when the member has been provided with a valid password to the members’ pages of the Society’s web site.
- Membership cannot be cancelled during a period which has already been paid for. Unless you pay by Direct Debit, membership will automatically terminate at the end of the period you have paid for if you do not renew. If you pay by Direct Debit, your membership will be renewed each year soon after it expires. If you pay by Direct Debit and decide that you do not wish to renew, and notify the Membership Secretary within 2 months of you being billed, we will refund the most recent payment. The terms of the Direct Debit Guarantee apply to all Direct Debit payments.
